Acknowledgment
These Terms govern your use of the Service and form the agreement between you and the Company. They set out the rights and obligations of all users of the Service.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
You represent that you are at least 18 years old, or the legal age for sports betting in your jurisdiction if that is higher. The Company does not permit anyone under that age to use the Service.
Your access to and use of the Service is also conditioned on your acceptance of the Company's Privacy Policy, which describes how we collect, use and disclose your personal information and explains your privacy rights. Please read it carefully before using the Service.
Nature of the Service
Information Only, Not Betting Advice
DataOdds is a sports betting data and analytics tool. The Service provides information only. Nothing in the Service, including any Data, alert, signal, model output, "edge", expected value or other indicator, is betting, financial, investment or professional advice, or a recommendation to place any particular wager.
You are solely responsible for every betting decision you make and for its outcome. Sports betting involves risk, and you may lose some or all of the money you wager. Past performance, historical results and backtests do not guarantee future results.
We Are Not a Sportsbook
The Company does not accept wagers, hold funds on your behalf, or act as a bookmaker, betting exchange or agent for any Sportsbook. Any wager you place is made directly with a Sportsbook, under that Sportsbook's own terms, and is a matter solely between you and that Sportsbook. We are not responsible for any Sportsbook's acts, omissions, pricing, limits, settlements, account restrictions or payouts.
Any reference to a Sportsbook in the Service is for informational purposes only and does not imply endorsement, affiliation or partnership unless we expressly say otherwise.
Accuracy and Timeliness of Data
We work hard to deliver accurate and timely Data, but odds and markets change rapidly and Data is sourced from third parties outside our control. Data may be delayed, incomplete, inaccurate or unavailable, and alerts and notifications may be delayed or fail to arrive. Prices shown in the Service may not match the prices available at a Sportsbook when you try to place a wager.
You should always confirm prices and market details directly with the relevant Sportsbook before placing any wager. To the maximum extent permitted by law, we are not liable for any loss arising from your reliance on the Data.
Legality in Your Jurisdiction
The laws governing sports betting vary by jurisdiction. You are solely responsible for ensuring that your use of the Service, and any wagering you do, is lawful where you are located. The availability of the Service in a jurisdiction does not mean that sports betting is legal there.
Responsible Gambling
Please gamble responsibly and only with money you can afford to lose. If you think you may have a gambling problem, help is available. In the United Kingdom, you can contact the National Gambling Helpline on 0808 8020 133 or visit https://www.begambleaware.org. In the United States, you can call or text 1-800-GAMBLER or visit https://www.ncpgambling.org.
Subscriptions
Plans and Subscription Period
Some parts of the Service are available only with a paid Subscription. We offer self-serve Subscription plans billed monthly or annually, and an Enterprise plan available by contacting us. The features, limits and prices of each plan are shown on the Website at the time of purchase. Enterprise plans may be governed by a separate written agreement, which prevails over these Terms where they conflict.
You will be billed in advance, on a recurring basis, for each billing period of the plan you select (monthly or annual). At the end of each billing period, your Subscription will automatically renew on the same terms unless you cancel it or the Company cancels it.
Prices are shown in U.S. dollars and exclude any applicable taxes unless stated otherwise. You are responsible for any taxes that apply to your purchase.
Free Trials
We may offer a Free Trial to new subscribers. Free Trial eligibility is determined at checkout, at our sole discretion, and returning customers or anyone who has previously had a Free Trial may not be eligible.
You may be required to provide valid billing information to start a Free Trial. Unless you cancel before the Free Trial ends, you will automatically be charged the applicable Subscription fee for the plan and billing period you selected when the Free Trial ends, and your Subscription will renew as described above. You will not be charged if you cancel before the Free Trial ends.
If you change plans during a Free Trial, the Free Trial ends and you will be charged immediately for the new plan.
We may modify or withdraw Free Trial offers at any time without notice.
Plan Changes
You can change your plan or billing period through your Account's subscription management page. Upgrades take effect immediately and may be charged on a pro-rated basis. Downgrades may take effect immediately or at the end of the current billing period, as shown when you make the change. The details of any charge or credit are shown before you confirm.
Subscription Cancellations
You can cancel your Subscription at any time through your Account's subscription management page, or by contacting us. Cancellation stops future renewals. You will keep access to your plan until the end of your current billing period, and you will not receive a refund for fees already paid for that period, except as set out in "Refunds" below.
Billing
Payments are processed by our third-party payment processor, Stripe. You must provide accurate and complete billing information, including a valid payment method, and keep it up to date. You authorize us, through our payment processor, to charge your payment method for all Subscription fees and taxes when due.
If a payment fails, we or our payment processor may retry the charge and may ask you to update your payment method. If payment is not received, we may suspend or downgrade your access until the outstanding amount is paid.
Fee Changes
The Company may change Subscription fees at any time. Any change will take effect at the start of your next billing period after notice is given.
We will give you reasonable advance notice of any fee change so that you have the opportunity to cancel before it takes effect. If you do not cancel, your continued use of the Service after the change takes effect constitutes your agreement to pay the new fee.
Refunds
Except where required by law, Subscription fees are non-refundable, including for partially used billing periods. We may consider refund requests case by case and grant them at our sole discretion.
Your Right to Cancel (UK and EU Consumers)
If you are a consumer in the United Kingdom or the European Union, you may have a legal right to cancel a contract for digital services within 14 days of entering into it. By starting a Free Trial or paid Subscription, you expressly request that we begin providing the Service immediately. If you cancel within the 14-day period after being charged, we may deduct an amount proportionate to the Service provided up to the date you told us you were cancelling. To exercise this right, contact us using the details in "Contact Us" below.
Promotions
Promotions made available through the Service may be governed by rules separate from these Terms. If you take part in a Promotion, please review its rules as well as our Privacy Policy. If a Promotion's rules conflict with these Terms, the Promotion's rules will apply.
Referral and affiliate programs may be subject to separate program terms. We may withhold, reverse or cancel referral rewards or discounts obtained through fraud, self-referral or other abuse.
User Accounts
When you create an Account, you must provide information that is accurate, complete and current, and keep it that way. Failure to do so is a breach of these Terms and may result in termination of your Account.
You are responsible for safeguarding your login credentials and for all activity under your Account, whether you sign in with a password or a third-party sign-in provider.
Accounts are for a single individual. You may not share your login credentials, allow anyone else to use your Account, or use one Subscription across multiple people. We may use technical measures to detect Account sharing, such as limits on concurrent sessions, and may suspend or terminate Accounts that are shared. If you need access for multiple people, please contact us about an Enterprise plan.
You must notify us immediately if you become aware of any breach of security or unauthorized use of your Account.
Acceptable Use
You agree not to, and not to allow or help anyone else to:
- Copy, resell, sublicense, redistribute, publish, broadcast or otherwise make available any Data to any third party, whether for free or for payment, except for occasional sharing of small, non-substantial portions for personal, non-commercial purposes (for example, a screenshot shared with a friend) with attribution to DataOdds.
- Use the Data to build, train, improve or operate any competing product or service, database, model or machine learning system.
- Scrape, crawl, spider or otherwise extract Data or content from the Service using automated means, or access the Service through any interface other than those we provide, unless we have given you written permission.
- Reverse engineer, decompile, disassemble or attempt to discover the source code, underlying models or data sources of the Service, except to the extent applicable law expressly permits this despite this restriction.
- Circumvent, disable or interfere with any security, authentication, rate limits, usage limits, plan restrictions or access controls of the Service.
- Interfere with or disrupt the integrity or performance of the Service, or attempt to gain unauthorized access to it or to related systems or networks.
- Introduce viruses, malware or other harmful code.
- Use the Service for any unlawful purpose, including in breach of gambling, anti-money-laundering or sanctions laws, or to facilitate betting by anyone underage or self-excluded.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Remove or obscure any proprietary notices in the Service.
We may investigate suspected breaches of this section and may suspend or terminate your Account, without refund, if we reasonably believe you have breached it.
User Content
The Service allows you to enter User Content, such as bet tracking records and saved preferences. You are responsible for your User Content and retain all rights in it.
You grant us a non-exclusive, worldwide, royalty-free license to host, store, process and display your User Content solely to provide, maintain and improve the Service for you. We may also use User Content in aggregated or de-identified form, so that it does not identify you, to analyze and improve the Service.
Although we take reasonable steps to protect your User Content, we do not guarantee that it will never be lost or corrupted. You are responsible for keeping your own copies of any User Content that is important to you.
Intellectual Property
The Service, including the Data as compiled and presented by us, the software, design, text, graphics, models and analytics, and all features and functionality, is and will remain the exclusive property of the Company and its licensors. It is protected by copyright, database rights, trademark and other laws of the Country and other countries.
Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own personal, non-commercial purposes (or, for Enterprise customers, for the internal purposes set out in your agreement). All rights not expressly granted to you are reserved by us.
Our names, logos, trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Copyright Complaints
We respect the intellectual property rights of others. If you believe that material available through the Service infringes your copyright or other intellectual property rights, please email us at support@dataodds.com with:
- Your name, address, telephone number and email address, and an electronic or physical signature of the rights holder or a person authorized to act on their behalf.
- A description of the work you claim has been infringed.
- The URL or other specific location in the Service where the material you claim is infringing is located.
- A statement that you have a good-faith belief that the disputed use is not authorized by the rights holder, its agent or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on the rights holder's behalf.
This procedure is intended to comply with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)). You may be liable for damages, including costs and legal fees, if you knowingly misrepresent that material is infringing.
Your Feedback to Us
If you send us Feedback, you assign to us all rights, title and interest in it. If for any reason that assignment is ineffective, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, sublicense, distribute, modify and exploit that Feedback without restriction or compensation to you.
Third-Party Services and Links
The Service may contain links to, or integrate with, third-party websites and services, including Sportsbooks, that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies or practices of any third-party websites or services. You acknowledge and agree that the Company is not responsible or liable, directly or indirectly, for any damage or loss caused, or alleged to be caused, by or in connection with your use of or reliance on any such content, goods or services.
We strongly advise you to read the terms and privacy policies of any third-party websites or services you visit.
Changes to the Service
We are constantly improving the Service and may add, change or remove features, Data sources, Sportsbooks, sports, markets or functionality at any time. We may also suspend the Service, or parts of it, for maintenance, security or other reasons. Where a change materially reduces the core functionality of your paid plan, we will make reasonable efforts to notify you in advance, and you may cancel your Subscription.
Termination
We may suspend or terminate your Account and access to the Service immediately, without prior notice or liability, if you breach these Terms, if we are required to do so by law, or if we reasonably believe your use of the Service poses a risk to us, other users or third parties. If we terminate your Account for any other reason, we will refund any prepaid fees for the unused portion of your current billing period.
You may stop using the Service and delete your Account at any time. Deleting your Account does not automatically cancel an active Subscription, so please cancel your Subscription first.
On termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination will survive, including the sections on Intellectual Property, Feedback, Limitation of Liability, Disclaimer, Indemnification and Governing Law.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the Company, its Affiliates, and their respective officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or related to your breach of these Terms, your misuse of the Service or the Data, or your violation of any law or the rights of any third party.
Limitation of Liability
To the maximum extent permitted by applicable law, the Company's total liability to you under or in connection with these Terms or the Service, whether in contract, tort (including negligence) or otherwise, is limited to the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) 100 U.S. dollars.
To the maximum extent permitted by applicable law, in no event will the Company or its suppliers be liable for any special, incidental, indirect or consequential damages whatsoever, or for any betting or gambling losses, lost winnings, loss of profits, loss of data or other information, business interruption or loss of privacy, arising out of or in any way related to the use of or inability to use the Service or the Data, even if the Company or any supplier has been advised of the possibility of such damages and even if a remedy fails of its essential purpose.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you. In those jurisdictions, our liability will be limited to the greatest extent permitted by law.
"AS IS" and "AS AVAILABLE" Disclaimer
The Service and the Data are provided "AS IS" and "AS AVAILABLE", with all faults and defects and without warranty of any kind. To the maximum extent permitted by applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, including all implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title and non-infringement, and warranties that may arise from course of dealing, course of performance, usage or trade practice.
Without limiting the foregoing, the Company makes no warranty or representation that the Service will meet your requirements, achieve any intended results (including any betting profit), be compatible with any other software or systems, operate without interruption, meet any performance or reliability standard, or be error-free, or that any errors or defects can or will be corrected. The Company makes no warranty as to the accuracy, reliability, completeness or timeliness of any Data, or that the Service, its servers, or emails sent by or on behalf of the Company are free of viruses or other harmful components.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on the statutory rights of consumers, so some or all of the above exclusions may not apply to you. In that case, they will apply to the greatest extent enforceable under applicable law.
Governing Law
These Terms and your use of the Service are governed by the laws of England and Wales, excluding their conflict-of-law rules. Your use of the Service may also be subject to other local, state, national or international laws.
Dispute Resolution
If you have any concern or dispute about the Service, you agree to first try to resolve it informally by contacting us. If it is not resolved within 30 days, either party may bring proceedings in the courts of England and Wales, which will have exclusive jurisdiction, except as set out in the next section.
For UK and EU Consumers
If you are a consumer resident in the United Kingdom or the European Union, you will benefit from any mandatory provisions of the law of the country in which you are resident, and nothing in these Terms affects your statutory rights as a consumer. You may also bring proceedings in the courts of the country where you live.
United States Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a United States, United Kingdom or European Union government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) you are not listed on any United States, United Kingdom or European Union list of prohibited or restricted parties.
United States Federal Government End Use Provisions
If you are a U.S. federal government end user, the Service is a "Commercial Item" as that term is defined at 48 C.F.R. §2.101.
Severability and Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Waiver
Except as provided in these Terms, failing to exercise a right or to require performance of an obligation does not affect a party's ability to exercise that right or require that performance at any later time, and waiving a breach does not waive any later breach.
Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition or sale of assets.
Entire Agreement
These Terms, together with our Privacy Policy and any additional terms you agree to for a specific plan or Promotion, form the entire agreement between you and the Company regarding the Service and replace any prior agreements on that subject.
Translation Interpretation
If we make these Terms available in other languages, the original English text will prevail in the event of any dispute.
Changes to These Terms
We may modify or replace these Terms at any time. If a change is material, we will make reasonable efforts to give at least 30 days' notice, by email and/or a prominent notice in the Service, before the new terms take effect.
By continuing to access or use the Service after the revised Terms take effect, you agree to be bound by them. If you do not agree to the new Terms, in whole or in part, please stop using the Service and cancel your Subscription.
